Granting a stay in the enforcement of Council File No. RLH RR 13-26, an Order to Remove or Repair the Structures at 217-219 WHITE BEAR AVENUE NORTH.
 
Body
WHEREAS, in the matter of Order to Remove or Repair the Structures at 217-1219 White Bear Avenue North, the Saint Paul Council granted 15 days for the razing and removal of the building(s) at this property since property owner was not able to provide adequate materials to indicate their willingness to make repairs to the property; and
 
WHEREAS, in the City Council's deliberation on this matter, Councilmembers indicated their willingness to reconsider the issue, should a viable plan for rehabilitation of the buildings at 217-219 White Bear Avenue North be found acceptable by both the vacant building's program manager and the legislative hearing officer in the 15-day time period the owner was granted to remove the building; and
 
WHEREAS, in the enuing 15-day time period, Michael Schleisman, Attorney for property owner, Bank of America, completed a plan for the rehabilitation of 217-219 White Bear Avenue North, which provided that the following conditions were met:
 
1.  post a $5,000 perfomance deposit; and
2.  provide a work plan with timelines in accordance with the Code Compliance Inspection Report;
 
WHEREAS, compliance with these conditions was carefully reviewed by both the legislative hearing officer and the vacant building program manager and found to be acceptable; now, therefore, be it
 
RESOLVED, that the City Council grants a 180 stay in the implementation of Council File No. RLH RR 13-26; and be it further
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter, granting a stay for a period of one hundred eighty(180) days for the completion of the rehabilitation of the property.
