Waiving the 45-day notice requirement and approving issuance of a Liquor Outdoor Service Area (Patio) and a Liquor Outdoor Service Area Sidewalk Café license for E S B Food and Drink LLC, d/b/a Ward 6 (License ID #20120000549) at 858 Payne Avenue.

WHEREAS, E S B Food and Drink LLC d/b/a Ward 6 (License ID #20120000549) applied for a Liquor Outdoor Service Area (Patio) and a Liquor Outdoor Service Area Sidewalk Café license for the premises located at 858 Payne Avenue in Saint Paul; and
WHEREAS, these licenses are to be added to the licensee's current Entertainment A, Liquor On Sale (100 seats or less),Liquor On Sale-Sunday and Restaurant (4) 51-150 Seats licenses; and
WHEREAS, the licensee obtained 9 out of a possible 15 signatures (60%) on the petition; and
WHEREAS, notices were sent out and DSI received a letter from Payne Phalen District Five Planning Council approving the 45 waiver and had no objections to the issuance of the Liquor Outdoor Service Area (Patio) and a Liquor Outdoor Service Area Sidewalk Café licenses; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the Liquor Outdoor Service Area (Patio) and a Liquor Outdoor Service Area Sidewalk Café licenses; now, therefore, be it,
RESOLVED, that a Liquor Outdoor Service Area (Patio) and a Liquor Outdoor Service Area Sidewalk Café license are hereby granted to E S B Food and Drink LLC d/b/a Ward 6 for the premises located at 858 Payne Avenue in Saint Paul.
