No ceiling height dimensions are provided in the orders, and the appellant indicates the ceiling is 6.75 feet tall, which could be interpretted in a couple of ways.  Can we get more precise dimensions?

Also, why didn't this come up in 2011 when a variance was provided for the ceiling height in the attic?  Is this a new space?  If so, I see no permits.

Body

WHEREAS, in the matter of Xuan Nguyen to a Fire Certificate of Occupancy Correction Notice at 1227 Magnolia Avenue East, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 3-inch variance on the ceiling height in the basement bedroom; Now, Therefore, Be It

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
