Approving adverse action against all licenses held by Checker Bar, Inc.at 992 Arcade Street.

Body

WHEREAS, adverse action was taken against all licenses held by Checker Bar, Inc., d/b/a Checker Bar (License ID #20100003374) for the premises located at 992 Arcade Street in Saint Paul by Notice of Violation dated June 6, 2013, alleging the licensee failed to provide a video recording to the Department of Safety and Inspections regarding an incident at the licensed premises on May 4, 2013, in violation of license condition #1; and    

WHEREAS, per to Saint Paul Legislative Code § 310.05(m) (2), the licensing office recommended a $500.00 matrix penalty; and    

WHEREAS, the licensee did respond to the Notice of Violation to contest the $500.00 matrix penalty and request a public hearing which was held on August 21, 2013; now, therefore, be it

RESOLVED, that Checker Bar, Inc., d/b/a Checker Bar is hereby ordered to pay a matrix penalty of $500.00 for failure to provide a video recording to the Department of Safety and Inspections regarding an incident at the licensed premises on May 4, 2013, in violation of license condition #1.  Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.     

This resolution, and action taken above, is based upon facts contained in the June 6, 2013, Notice of Violation sent to the licensee and the arguments made at the public hearing on August 21, 2013.
