Approving adverse action against the Taxicab Driver license held by David M. Arth.
 
Body
WHEREAS, adverse action was taken against the Taxicab Driver license held by David M. Arth (License ID #19980008852) for the City of Saint Paul, by Notice of Intent to Revoke License dated May 30, 2013, stating the licensee was convicted in Ramsey County of five (5) Felony counts of Possession of Pornographic Work-Computer Dist/Electronic/Magnetic/Optical Image w/Porn in violation of Minn. Stat. § 617.247.4(a); and
 
WHEREAS, based on these convictions, the licensing office recommended revocation of his license per Saint Paul Legislative Code § 310.06 (b) (6) (a) and (c); and
 
WHEREAS, on June 10, 2013, the Assistant City Attorney received a fax from the licensee's attorney requesting and extension to respond to the Notice of Intent to Revoke License;
 
WHEREAS, on July 10, 2013, the Assistant City Attorney sent the licensee's attorney a letter stating that she had not received a response to the Notice of Intent to Revoke License and gave him until July 24, 2013 to respond; and
 
WHEREAS, the licensee or his attorney failed to respond to the Notice of Intent to Revoke License by the July 24, 2013 deadline; and
 
WHEREAS, the Notice of Intent to Revoke License stated that if the licensee failed to request a public or administrative by June 10, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
 
RESOLVED, the Taxicab Driver license held by David M. Arth is hereby revoked.
