Approving adverse action against the Massage Center - A (Commercial) license held by Mella & Company, Inc., d/b/a Mella Day Spa at 1204 Grand Avenue.

WHEREAS, adverse action was taken against the Massage Center - A (Commercial) license held by Mella & Company, Inc. d/b/a Mella Day Spa (License ID #0082171) for the premises located at 1204 Grand Avenue in Saint Paul, by Notice of Intent to Suspend License dated June 5, 2013, alleging licensee failed to pay delinquent license and late fees of $333.00, submit a current list of employees with their license numbers and a completed Certificate of Compliance Minnesota Workers’ Compensation Law form; and
WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, on June 17, 2013, the licensee did respond to the Notice of Intent to Suspend License to state that she wished to keep her license and she would be paying the delinquent license and late fees and sending in the required information; and
WHEREAS, According to DSI records, the licensee failed to follow-up the telephone conversation to pay the delinquent license and late fees and submit the required information; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the delinquent license and late fees, submit the required information or request a hearing by June 17, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Massage Center - A (Commercial) license held by Mella & Company, Inc. d/b/a Mella Day Spa is hereby suspended for failure to pay delinquent license and late fees of $333.00.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required information in order to maintain the license.
