Approving adverse action against the Pedal Car Business and Pedal Car licenses held by 3 Buckaroos, LLC, d/b/a Amsterdam Pedals.

WHEREAS, adverse action was taken against the Pedal Car Business and Pedal Car licenses held by 3 Buckaroos, LLC d/b/a Amsterdam Pedals (License ID #20130001653) for the City of Saint Paul, by Notice of Violation dated June 6, 2013, stating the Department of Safety and Inspections received a complaint and photographs on May 17, 2013 regarding an incident on May 13, 2013; and
WHEREAS, according to the complaint the licensee violated several sections of Saint Paul Legislative Code Chapter 374 (Commercial Pedal Cars) by: 1) operating before the license was issued in violation of § 374.2(a); 2) operating before the route had been approved by the Department of Safety and Inspections in violation of § 374.5(b); 3) the company name was not displayed on the vehicle in violation of § 374.12 (e) and a large bottle of whiskey was photographed on board the vehicle in violation of § 374.12 (p); and
WHEREAS, per Saint Paul Legislative Code § 310.05(m) (2), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to pay the $500.00 matrix penalty or request a hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a hearing by June 17, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that 3 Buckaroos, LLC d/b/a Amsterdam Pedals is hereby ordered to pay a matrix penalty of $500.00 for several violations to Chapter 374 (Commercial Pedal Cars). Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
