Approving adverse action against the Second Hand Dealer (Antiques) license application submitted by Kazan C. Dietrich, d/b/a Crazy Kazan's at 1624 White Bear Avenue North.

WHEREAS, adverse action was taken against the Second Hand Dealer (Antiques) license application submitted by Kazan C. Dietrich d/b/a Crazy Kazan's (License ID #20130001381) for the premises located at 1624 White Bear Avenue North in Saint Paul, by Notice of Intent to Deny License dated April 25, 2013 alleging the licensee was convicted of a Felony on May 18, 2004 and January 2, 2009 and several Gross Misdemeanors in 2004, 2005 and 2008; and
WHEREAS, the licensing office determined these convictions were directly related to the license activity and recommended license denial; and
WHEREAS, the licensee did respond to the City Attorney's Office on May 1, 2013 expressing concern about the Notice of Intent to Deny License; and
WHEREAS, on May 3, 2013, the City Attorney's Office sent the licensee a follow-up letter requesting that he provide information regarding the his convictions and whether the information was accurate; and
WHEREAS, on May 22, 2013, the City Attorney's Office spoke with the licensee and gave him an extension of two (2) weeks to decide whether to request a hearing or withdraw his license application; and
WHEREAS, the licensee has failed to respond to the May 3, 2013 letter and May 22, 2013, conversation to request a hearing or withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to request a hearing or withdraw the license application by May 6, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Second Hand Dealer (Antiques) license application submitted by Kazan C. Dietrich d/b/a Crazy Kazan's is hereby denied.
