Declaring the necessity of tabulating votes on November 11, 2013.
Body
WHEREAS, the City General Election will be held on November 5, 2013; and
WHEREAS, Legislative Code § 31.05(b) mandates that the City Council canvass the votes no less than three and no more than seventeen days after the election and the only regular City Council meetings during this period are to be held on November 13 or November 20, 2013; and
WHEREAS, the public interest is best served by a canvass on November 13, 2013, which is the most prompt canvass possible; and
WHEREAS, the City Clerk and the Ramsey County Elections Manager, as the chief election official as defined in Legislative Code § 31.02, advise that to complete the tabulation of votes in the manner required by law before November 13, 2013, it is necessary to conduct the tabulation of votes on November 9, 11, and 12, 2013; and
WHEREAS, November 11, 2013, is a "Holiday," as defined in Minn. Stat. § 645.44 subd. 5 (2012), which is a day on which no public business is to be transacted except in cases of necessity, NOW THEREFORE BE IT,
RESOLVED, that the City Council requests the chief election official to conduct the tabulation of votes on November 11, 2013, along with the other dates stated so that the canvass may be held on November 13, 2013; and
FURTHER RESOLVED that the City Council hereby declares it is necessary and in the best interest of the public to conduct the vote tabulation for the 2013 City General Election on November 11, 2013, along with the other dates stated.
