Approving adverse action against all licenses held by M & W Market, Inc., d/b/a Burr St Market located at 962 Burr Street.

WHEREAS, adverse action was taken against all licenses held by M & W Market, Inc. d/b/a Burr St Market (License ID #20090005122) for the premises located at 962 Burr Street in Saint Paul, by Notice of Intent to Revoke Licenses dated April 19, 2013, alleging on April 5, 2013, the licensee Was sent a Notice of Condemnation Unfit for Human Habitation Order to Vacate, the building was then condemned and the Certificate of Occupancy was revoked; and
WHEREAS, Saint Paul Legislative Code ยง 40.01(a) requires that "all existing buildings in the city are required to have and maintain a fire certificate of occupancy, issued by the fire marshal"; and
WHEREAS, the licensee did not respond to the Notice of Intent to Revoke Licenses to request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Revoke Licenses stated that if the licensee failed to request a public or administrative hearing by April 29, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, all licenses held by M & W Market, Inc. d/b/a Burr St Market are hereby revoked.
