WHEREAS, adverse action was taken against all licenses held by Kadi Brothers, Inc. d/b/a VAS Market (License ID #201100004084) for the premises located at 169 Victoria Street North in Saint Paul by Second Amended Notice of Intent to Revoke Licenses dated April 16, 2013, alleging that the licensed establishment purchased and possessed stolen merchandise, engaged in food stamp trafficking, possessed drug paraphernalia, allowed individuals to purchase narcotics on the premises, and sold single cigarettes, in violation of Saint Paul Legislative Code sections 310.06(b)(6) (a) and (c) and 310.06(b)(8); and

WHEREAS, the licensee admitted the allegations in the Second Amended Notice of Intent to Revoke Licenses for the purposes of this proceeding and requested a public hearing before Council, which was held on May 1, 2013; and

WHEREAS, the Council finds that the licensed establishment engaged in and supported criminal activity in its purchase and possession of stolen retail merchandise, possession of drug paraphernalia, and allowance of drug activity on its premises. Furthermore, the licensed establishment trafficked EBT cards, exchanging needed nutrition benefits for cash. The totality of the admitted allegations show that the licensed establishment operated as a criminal fence, diverted nutrition benefits, and harbored conduct and conditions that contribute to neighborhood degradation and acceptance of illegal activity, which are substantial and compelling reasons justifying an upward departure from any presumptive penalty in Legislative Code section 310.05(m). Now, therefore be it

RESOLVED, that all licenses held by Kadi Brothers, Inc. d/b/a VAS Market are hereby REVOKED.
