Approving adverse action against the Taxicab Driver (Provisional) license application submitted by Brad L. Sternaman.

WHEREAS, adverse action was taken against the Taxicab Driver (Provisional) license application submitted by Brad L. Sternaman (License ID #20130000965) for the City of Saint Paul by Notice of Intent to Deny License dated March 20, 2013, alleging the licensee was convicted on August 10, 1999 of Felony Burglary - 1st Degree-Dwelling-Occupied-Non-Accomplice Present (Minn. Stat. § 609.582.1(a) in Ramsey County; and
WHEREAS, the licensee/applicant was placed on supervised probation for twenty (20) years, but was then discharged from that probation on June 17, 2008 after being convicted of Felony Predatory Offender-Knowingly Violates Registration Requirement or Intentionally Provides False Information (Minn. Stat. § 243.166.5 (a) in Ramsey County; and
WHEREAS, the licensee/applicant was released from probation for that conviction on October 23, 2009; and
WHEREAS, Saint Paul Legislative Code § 376.16 (e) (4) (a), states "the licensee shall not be under sentence or have been discharged from sentence for any felony conviction with the five (5) years immediately preceding application for a license", and
WHEREAS, this conviction and discharge from probation on October 23, 2009, was within five (5) years preceding application, the licensing office recommended license denial; and
WHEREAS, the licensee/applicant did not respond to the Notice of Intent to Deny License to request a hearing or withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the licensee/applicant failed to request a hearing or withdraw his license application by April 1, 2013, the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Taxicab Driver (Provisional) application submitted by Brad L. Sternaman is hereby denied.
