Approving adverse action against Nazir M. Alsadi, an employee of Hana Co., d/b/a Premium Stop, 1529 White Bear Avenue North.

Body

WHEREAS, adverse action was taken against Nazir M. Alsadi, an employee of Hana Co. d/b/a Premium Stop for the premises located at 1529 White Bear Avenue North in Saint Paul by Notice of Administrative Fine dated March 20, 2013, alleging that on March 14, 2013, she sold tobacco products to an underage person in violation of Minn. Stat. § 461.12, Subd. 3; and   

WHEREAS, this was the first violation regarding the sale of cigarettes to an underage person, so the licensing office recommended a $50.00 administrative fine; and     

WHEREAS, licensee did respond to the Notice of Administrative Fine on March 26, 2013 to request a public hearing which was held on May 1, 2013; now therefore be it

RESOLVED, that Nazir M. Alsadi is hereby ordered to pay a $50.00 administrative fine for the sale of tobacco products to an underage person on March 14, 2013.  Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.     

This resolution, and action taken above, is based upon facts contained in the March 20, 2013, Notice of Administrative Fine sent to the clerk and the arguments made at the public hearing on May 1, 2013.
