Authorizing the Director of Public Works to request a variance from the Minnesota Department of Transporation for the Raymond Avenue Reconstruction Project.  (Number 13-T-1319)
 
Body
WHEREAS, the City of Saint Paul wishes to reconstruct RAYMOND AVENUE from University Avenue to Hampden Avenue using Municipal State Aid and Federal funds; and
WHEREAS, the State Aid Rule 8820.99036 Minimum Design Standards, Urban; New or Reconstruction Projects requires a minimum 30 mph design speed; and
WHEREAS, the existing horizontal curve has an adverse superelevation and an existing radius of 262'; and
WHEREAS, existing right-of-way and infrastructure constrains the size of the curve; and
WHEREAS, the City wishes to maintain the 262' curve radius (25 mph); and
WHEREAS, the proposed rain garden designed to meet watershed rules requires the roadway to drain toward it; and
WHEREAS, the City wishes to drain the surface water to the rain garden; and
WHEREAS, the City is redesigning the existing, skewed intersection of Bayless Avenue and Raymond Avenue; and
WHEREAS, the new Bayless alignment will intersect Raymond Avenue at the north end of the curve; and
WHEREAS, constructing superelevation on Raymond would detrimentally affect the grades of the new intersection of Bayless; therefore, be it
RESOLVED, that we do hereby authorize the Director of Public Works to request a variance from the MnDOT Road Design Requirement of constructing superelevation on this curve on Raymond Avenue.
BE IT FURTHER RESOLVED, that the Saint Paul City Council hereby indemnifies, saves and holds harmless the State of Minnesota and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of the granting of the variance.  The City further agrees to defend at its sole cost and expense any action or proceeding commenced for the purpose of asserting any claim arising as a result of the granting this variance.
