Title
Accepting 10 parcels of real property in Lilydale Regional Park from Ramsey County, and authorizing execution of an Agreement and Restrictive Covenant between the City and the Metropolitan Council affecting four of the parcels.

Body
WHEREAS, in January 1984 Ramsey County (“County”) and the City of Saint Paul (“City”) entered into an agreement to exchange then-County-owned property within Lilydale Regional Park (“Lilydale Park”) for then-City-owned property within Battle Creek Regional Park and the Pig’s Eye Lake Unit; and

WHEREAS, on February 19, 1997, by Resolution CF 97-175, the City Council approved the acceptance of the County’s Lilydale Park property; and

WHEREAS, the conveyance of said Lilydale Park property did not include ten (10) parcels located within three areas of the park (“Remaining Parcels”), those areas being identified as the Lilydale Marina Demolition Site, the Lilydale Dump Site and the Kamish Dump Site, as shown on Exhibit A attached hereto; and

WHEREAS, the Department of Parks and Recreation has received funding to perform environmental cleanup of said areas by removing, sorting and crushing concrete, bituminous and dimension stone contained within them, and subsequently re-using the materials for a future roadway and picnic shelter in the park, followed by re-grading and re-vegetating of the areas with native plant material; and

WHEREAS, the City now requires ownership of the Remaining Parcels in order to complete the cleanup work, and the County desires to complete the conveyance of the Remaining Parcels, as documented in a Quit Claim Deed attached hereto as Exhibit B; and

WHEREAS, four (4) of said Remaining Parcels are subject to a restrictive covenant between the County and the Metropolitan Council (“Met Council”) in connection with a Met Council grant for the County’s original purchase of said parcels; and
