Approving adverse action against all licenses held by TSWJLAUG, Inc., d/b/a Rice Palace Asian Buffet at 1626 White Bear Avenue North.
 
Body
WHEREAS, adverse action was taken against all licenses held by TSWJLAUG, Inc. d/b/a Rice Palace Asian Buffet (License ID #20100000030) for the premises located at 1626 White Bear Avenue North in Saint Paul, by Notice of Intent to Suspend License dated January 16, 2013, alleging licensee failed to pay $1,153.50 in delinquent license and late fees for their Wine On Sale (2nd half) license, submit their State Liquor Renewal Certificate and copies of their monthly state sales and use tax statements from the previous twelve months from the Minnesota Department of Revenue; and
 
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and   
 
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend License to pay the delinquent license and late fees and submit the required information or request a hearing; and
 
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the delinquent license and late fees and submit the required information or request a hearing by January 28, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
 
RESOLVED, all licenses held by TSWJLAUG, Inc. d/b/a Rice Palace Asian Buffet are hereby suspended for failure to pay delinquent license and late fees of $1,153.50.
 
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required information in order to maintain the license.
 
The licenses will remain suspended until all license fees and penalties are paid in full and all required information is submitted to the Department of Safety and Inspections.
