Approving adverse action against the Taxicab Driver (Provisional) license application submitted by Jeffry Jermayn Solinger.

WHEREAS, adverse action was taken against the Taxicab Driver (Provisional) license application submitted by Jeffry Jermayn Solinger (License ID #0093271) for the City of Saint Paul by Notice of Intent to Deny License dated January 9, 2013, alleging the licensee was convicted on January 4, 2008 of Felony Traffic - DWI - Operate Motor Vehicle Under Influence of Alcohol (Minn. Stat. § 169A.20.1(1) in Goodhue County; and
WHEREAS, the licensee was placed on seven (7) years of supervised probation but was then discharged from probation on August 7, 2012; and
WHEREAS, this is a violation of Saint Paul Legislative Code § 376.16 (e) (4) (a), which states "the licensee shall not be under sentence or have been discharged from sentence for any felony conviction with the five (5) years immediately preceding application for a license", and
WHEREAS, as a result of this conviction and discharge from probation within five (5) years preceding application, the licensing office recommended license denial; and
WHEREAS, the licensee did not respond to the Notice of Intent to Deny License to request a hearing or withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to request a hearing or withdraw his license application by January 21, 2013, the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Taxicab Driver (Provisional) application submitted by Jeffry Jermayn Solinger is hereby denied.
