Approving adverse action against the Taxicab Driver (Provisional) license application submitted by David Charles Laverty.

WHEREAS, adverse action was taken against the Taxicab Driver (Provisional) license application submitted by David Charles Laverty (License ID #20120005108) for the City of Saint Paul by Notice of Intent to Deny License dated December 26, 2012, alleging the licensee was convicted on June 29, 2011 of Misdemeanor Domestic Abuse - Violate Order for Protection in Chisago County; and
WHEREAS, the licensee was placed on two (2) years probation from June 29, 2011 to June 29, 2013, which is a violation of Saint Paul Legislative Code ยง 376.16 (e) (4) (a); and
WHEREAS, as a result of this conviction, the licensing office recommended license denial; and
WHEREAS, on November 20, 2012, the City Attorney's Office sent the licensee a Letter of Inquiry requesting an explanation of the June 29, 2011 incident and received no response from the licensee; and
WHEREAS, the licensee did not respond to the Notice of Intent to Deny License to request a hearing or withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the licensee failed to request a hearing or withdraw his license application by January 7, 2013, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Taxicab Driver (Provisional) application submitted by David Charles Laverty is hereby denied.
