THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
                                                      SECTION 1
Chapter 360 of the Saint Paul Legislative Code is hereby amended to read as follows:
Chapter 360. - Public Swimming Pools
 
Sec. 360.01. - License required.
No person shall conduct, operate or maintain a public swimming pool in Saint Paul without a license.
 
Sec. 360.02. - Definitions.
 
Definitions of words, phrases, and terms used in this chapter shall be those set forth in Minnesota Administrative Rules 4717.0250 as well as any other state statues or rules relating to public swimming pools.
 
Public swimming pool means any pool other than a private residential pool, that is:
 
(1)  Open to the public generally, whether for a fee or free of charge;
(2)  Open exclusively to members of an organization and their guests;
(3)  Open to residents of a multiunit apartment building, apartment complex, residential real estate development, or other multifamily residential area;
 
(4)  Open to patrons of a hotel or lodging or other public accommodation facility; or
(5)  Operated by a person in a park, school, licensed child care facility, group home, motel, camp, resort, club, condominium, manufactured home park, or political subdivision with the exception of swimming pools at family day care homes licensed under Minnesota Statute section 245A.14, subdivision 11, paragraph (a).
 
Sec. 360.03. - Fee.
The fee required for a license shall be established by ordinance as specified in section 310.09(b) of the Legislative Code.
 
Sec. 360.04. - Licensing requirements; submission of plans and specifications.
The following requirements shall apply to the licensing of public swimming pools:
 
(1)  No person shall begin construction of a public swimming pool or shall substantially alter or reconstruct any public swimming pool without first having submitted plans and specifications to the Minnesota Department of Health (MDH) for review and approval. All plans and specifications shall also be submitted in duplicate for review and approval by the department of safety and inspections building official.
 
No permit to construct, alter or renovate shall be issued by the inspector until approval is granted by the Minnesota Department of Health and department of safety and inspections.
 
(2)  The application for a permit to construct or remodel a public swimming pool shall be on forms prescribed by the department of safety and inspections, together with any supporting data as may be required for the proper review of the plans.
(3)  The pool and facilities shall be built in accordance with the plans as approved by the Minnesota Department of Health and the building official. Changes or modifications of said plans must be submitted to and approved by the Minnesota Department of Health and by the building official. The owner or his agent shall notify the Minnesota Department of Health and director of the department of safety and inspections at specific predetermined stages of construction to permit adequate inspection of the pool and related equipment during and after construction. A final inspection shall be made upon completion of the pool facilities. The pool shall not be placed in operation until such inspections show compliance with the requirements of this chapter.
 
Sec. 360.05. - Standards for construction, operation, and maintenance.
All public pools must comply with Minnesota Statutes section 144.1222 and Minnesota Administrative Rules chapter 4717.0150 to 4717.3970 (Pool Code) in effect on the effective date of this chapter, as it may be amended from time to time. are is hereby adopted by reference and made a part of this chapter.
 
Sec. 360.06. - Regulations to be promulgated.
The department of safety and inspections is authorized to promulgate regulations in connection with the operation and maintenance of public swimming pools for the protection and promotion of public health and safety. The inspector from the department of safety and inspections shall perform inspections at reasonable hours to ensure compliance.
 
Sec. 360.07. - Inspection.
The department of safety and inspections is authorized to conduct such inspections as it deems necessary to ensure compliance with all provisions of this chapter and shall have the right of entry at any reasonable hour to the swimming pool for this purpose.
 
Sec. 360.08. - Licenses not transferable.
Licenses issued pursuant to this chapter are not transferable.
 
Sec. 360.09. - Reissuance after revocation.
 
Reapplication may be made following a license revocation, and upon presentation of evidence that the deficiencies causing revocation have been corrected, the inspector may reissue the license.
 
 
                                                      SECTION 2
 
This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and publication.
