Approving changes to Rule 7 of the City of Saint Paul Civil Service Rules to properly reflect recent changes in Minnesota State Law regarding additional points to Veteran applicants.

RESOLVED, Rule 7 of the City of Saint Paul Civil Service Rules establishes additional points to be added to the scores of Veterans of the United States Armed Forces in accordance with Minnesota State Law; and
WHEREAS, Chapter 192 (HF 1416/SF 1689) amended Minnesota State Law, Minn. Stat. §197.455, subds 4 and 5 regarding disabled and nondisabled veterans credit effective April 19, 2012.  The amendment can be summarized as follows:
Nondisabled veterans credit increased.  Section 5 amends Minn. State § 197.455, subd. 4 by increasing the nondisabled veteran's credit from 5 points to 10 points.  The credit is given to a nondisabled veteran who elects to receive a credit in a competitive open examination rating, under civil service laws, charter provisions, ordinances, rules or regulations of a county, city, town, school district, or other municipality or political subdivision.  
 
Disabled veterans credit increased.  Section 6 amends Minn. Stat. § 197.455, subd. 5 by increasing the disabled veteran's credit from 10 to 15 points.  The credit is given to a disabled veteran who elects to receive a credit in a competitive open examination rating under civil service laws, charter provisions, ordinances, rules, or regulations of a county, city, town, school district, or other municipality; and
 
WHEREAS, State Law supercedes the City of Saint Paul Civil Service Rules; and
WHEREAS, Rule 7 must be amended to properly reflect Minnesota State Law; and
NOW, THEREFORE, BE IT RESOLVED, pursuant to the authority granted in the Section 12.06 of the Saint Paul City Charter, the City Council hereby approves and amends Rule 7 to follow Minnesota State Law.  In all other respects, Rule 7 shall remain the same.
7.  Eligible Lists
The names of all applicants who pass the examination shall be placed on an eligible list in the order of their examination scores, and shall remain on the list until they are hired or until the list expires.  If any applicant's scores are equal to the scores of anyone certified under Section 8.A. of these Rules, their names shall also be certified.  In the case of an open continuous examination, all applicants who pass the examination can be certified in accordance with Section 8 of these Rules as if there was a new examination for such title each day.  The names of those not immediately employed shall be placed on an eligible register in the order of their scores.
If any applicant is a Veteran, additional points shall be added to their score, in accordance with Minnesota State Law:.
a.      Five points for the first promotional examination taken by a disabled veteran who has a permanent service connected disability of 50% or more.
b.      Five points for original entrance examinations; if not disabled.
c.      Ten points for original entrance examinations taken by veterans with service-connected disabilities.
