Approving the issuance of an Animal Boarding (Home Occupation) license for Wagner's Pet Sitting (License ID # 20120004065), 1240 Prosperity Avenue.

WHEREAS, Wagner's Pet Sitting, LLC d/b/a Wagner's Pet Sitting located at 1240 Prosperity Avenue, has requested the issuance of an Animal Boarding (Home Occupation) license; and
WHEREAS, the licensee, as part of the application process, is required by Saint Paul Legislative Code § 348.04 (b) to obtain signatures of as many owners or private residences, dwellings and apartment house located within one hundred fifty (150) feet of the premises; and
WHEREAS, the licensee was able to obtain ten (10) of the twelve (12) potential supportive signatures required or eighty-three (83) percent of the residents within one hundred fifty (150) feet of the premises; and
WHEREAS, because the licensee received consent of only eighty-three (83) percent of owners within one hundred and fifty (150) feet, per Saint Paul Legislative Code § 348.04 (b) (1), he is required to demonstrate to City Council in writing a good faith effort was made to fulfill all petition requirements; and
WHEREAS, the licensee submitted with his application a document showing attempts to get the petition signed by all property owners; and
WHEREAS, the Council finds that issuance of the license with conditions will not interfere with the reasonable use and enjoyment of neighboring property and residences and will not bear adversely on the health, safety, morals and general welfare of the community; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the license; and
RESOLVED, that an Animal Boarding (Home Occupation) license be issued to Wagner's Pet Sitting, LLC d/b/a Wagner's Pet Sitting located at 1240 Prosperity Avenue in Saint Paul with the following conditions:
1) The licensee agrees to remain in compliance with all standards and conditions stipulated
under the City of Saint Paul Zoning Code for a home occupation.
2) Licensee agrees that at no time shall there be more than a maximum total of three (3) animals (including any animals residing in the home) on the premises.
