Approving adverse action against the Dance or Rental Halls license held by Jonah Ogiamien at 508 Snelling Avenue North.

WHEREAS, adverse action was taken against the Dance or Rental Halls license held by Jonah Ogiamien d/b/a Jonah Ogiamien (License ID #19990005112) for the premises located at 508 Snelling Avenue North in Saint Paul, by Notice of Violation sent November 6, 2012, alleging the licensee was convicted on October 29, 2012, of Gross Misdemeanor Disorderly House-Own or Operate in Ramsey County; and
WHEREAS, this was the third violation within a twelve-month period; therefore, per Saint Paul Legislative Code ยง 310.05 (m) (2), the licensing office recommended a $2,000.00 matrix penalty and a 10-day suspension of the Dance or Rental Halls license; and
WHEREAS, the licensee did not respond to the Notice of Violation to request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated if the licensee failed to request a public or administrative hearing by November 16, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Dance or Rental Halls license held by Jonah Ogiamien d/b/a Jonah Ogiamien is hereby suspended for a period of ten (10) days. Said suspension will begin at 12:00 a.m. Wednesday, December 26, 2012 until 11:59 p.m., Friday, January 4, 2013.
FURTHER RESOLVED, the licensee is hereby ordered to pay a $2,000.00 matrix penalty. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
