Approving adverse action against all licenses held by Coale, Inc., d/b/a Coale's Bar & Grill, 719 Dale Street North.

WHEREAS, adverse action was taken against all licenses held by Coale, Inc., d/b/a Coale's Bar & Grill (License ID #20100003019) for the premises located at 719 Dale Street North in Saint Paul by Notice of Intent to Revoke Licenses dated October 29, 2012, alleging the licensee failed to pay Liquor On Sale 101-180 Seats second half license fees which were due December 31, 2011, and renew their remaining licenses by paying the delinquent license and late fees which were due by June 3, 2012; and
WHEREAS, on September 4, 2012, Fire Inspection notified DSI that the water had been shut off and the Certificate of Occupancy was revoked due to the fact that the building was now vacant; and
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (8), the licensing office recommended revocation of all licenses; and
WHEREAS, the City Attorney's Office received a call from a partner of the licensee indicating that he was interested in paying the delinquent license and late fees and he was referred to DSI; and
WHEREAS, DSI informed the partner that they needed the licensee to contact them regarding a payment plan; and
WHEREAS, the licensee failed to contact DSI regarding a payment plan and did not respond to the Notice of Intent to Revoke Licenses to request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Revoke Licenses stated that if the licensee failed to request a public or administrative hearing by November 8, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that all licenses held by Coale, Inc., d/b/a Coale's Bar & Grill are hereby revoked.
