Approving adverse action against all licenses held by Dethvongxay Sonvanaphong, d/b/a Thai Ginger Deli, 1001 Johnson Parkway, Unit #7.
Body
WHEREAS, adverse action was taken against all licenses held by Dethvongxay Sonvanaphong d/b/a Thai Ginger Deli (License ID #20100003775) for the premises located at 1001 Johnson Parkway, Unit #7 in Saint Paul by Notice of Violation dated October 18, 2012, alleging the licensee was cited for two (2) Critical-Major Environmental Health Code violations during a re-inspection of the licensed premises on October 4, 2012; and    
 
WHEREAS, pursuant to Saint Paul Legislative Code ยง 310.05 (m) (9), the licensing office recommended a $375.00 matrix penalty for the two (2) violations and suspension of all licenses until the violations are corrected; and
WHEREAS, the licensee did not respond to the Notice of Violation to pay the $375.00  matrix penalty or follow-up and contact the Environmental Health Code Inspector to schedule a re-inspection; and  
 
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $375.00 matrix penalty and contact the inspector to schedule a re-inspection by October 29, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Dethvongxay Sonvanaphong d/b/a Thai Ginger Deli is hereby ordered to pay the $375.00 matrix penalty for failure to correct the two (2) outstanding Critical-Major Environmental Health Code violations cited by the inspector during the re-inspection of the licensed premises on October 4, 2012.
FURTHER RESOLVED, all licenses held by Dethvongxay Sonvanaphong d/b/a Thai Ginger Deli are immediately suspended and will remain suspended until the licensee corrects the two (2) outstanding Critical-Major Environmental Health Code violations.
