BE IT RESOLVED, that upon the petition of Keith Schweiger ("Petitioner"), as documented in Office of Financial Services Vacation File Number 4-2012, the public property described as:

That portion of University Avenue, as dedicated in the plat of SANBORN'S MIDWAY ADDITION TO ST. PAUL, MINN., according to the recorded plat thereof, Ramsey County, Minnesota, adjoining the East Half of Lot 26 and all of Lots 27, 28, 29 and 30, Block 7, said SANBORN'S MIDWAY ADDITION TO ST. PAUL, MINN., which lies easterly of the southerly extension of the west line of the East Half of said Lot 26, which lies westerly of the southerly extension of the east line of said Lot 30 and which lies northerly of a line drawn 60.00 feet northerly of and parallel with the south line of the Northeast Quarter of Section 34, Township 29 North, Range 23 West, said Ramsey County,

and depicted in Exhibit A attached hereto, is hereby vacated and discontinued as public property and, subject to the following conditions, the easements within said public property are hereby released:

1. This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the Saint Paul Legislative Code as amended.
2. The Petitioner, its successors and assigns shall pay $1,200.00 to the City of Saint Paul as an administrative fee for this vacation which is due and payable within 60 days of the effective date of this resolution.
3. The Petitioner, its successors and assigns shall, within 60 days of the effective date of this resolution, file with the Office of Financial Services/Real Estate Section, an acceptance in writing of the conditions of this resolution and shall, within the period specified in the terms and conditions of this resolution, comply in all respects with these terms and conditions.
