Approving adverse action against all licenses held by Stephen R. Mike, d/b/a Wabasha Deli & Café, 32 Fillmore Avenue East.
Body
WHEREAS, adverse action was taken against all licenses held by Stephen R. Mike d/b/a Wabasha Deli & Café (License ID #20080000391) for the premises located at 32 Fillmore Avenue East in Saint Paul by Notice of Violation dated October 1, 2012, alleging the licensee was cited for one (1) Critical-Major Environmental Health Code violation during a re-inspection of the licensed premises on August 28, 2012; and
WHEREAS, per Saint Paul Legislative Code § 310.05 (m) (9), the licensing office recommended a $175.00 matrix penalty and suspension of all licenses until the violation was corrected; and
WHEREAS, the licensee did not respond to the Notice of Violation to pay the $175.00 matrix penalty and contact the Environmental Health Inspector to schedule a re-inspection; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $175.00 matrix penalty and contact the Environmental Health Inspector by October 11, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, all licenses held by Stephen R. Mike d/b/a Wabasha Deli & Café are hereby immediately suspended and the licensee ordered to pay a $175.00 matrix penalty for failure to correct the one (1) Critical-Major Environmental Health Code violation cited during a re-inspection of the licensed premises on August 28, 2012.
The licenses shall remain suspended until the licensee corrects the one (1) outstanding Critical-Major Environmental Health Code violation and pays the $175.00 matrix penalty.
