WHEREAS, adverse action was taken against the Retail Food Establishment - Farmer's Market license held by Andrea K. Pesses d/b/a Groveland Confections (License ID #20110000373) for the premises located at 290-5th Street East in Saint Paul, by Notice of Intent to Suspend License dated July 19, 2012, alleging the licensee failed to pay delinquent license and late fees in the amount of $244.00 and submit a completed Certificate of Compliance Minnesota Workers' Compensation Law form; and
WHEREAS, on August 7, 2012, the licensee did respond to the Notice of Intent to make arrangements with DSI to pay one-half of the delinquent license and late fees ($122.00) by August 15, 2012 and the second-half ($122.00) by August 22, 2012; and
WHEREAS, on August 22, 2012, the Department of Safety and Inspections received the first $122.00 payment which was due on August 15, 2012; and
WHEREAS, the licensee then failed to send the second payment of $122.00 by the August 22, 2012 deadline and submit the required information; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay all of the delinquent license and late fees and submit the required information or request a hearing by July 30, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Retail Food Establishment - Farmer's Market license held by Andrea K. Pesses d/b/a Groveland Confections is hereby suspended and will remain suspended until the licensee pays the remaining $122.00 in delinquent license and late fees and submits the required information.
