Authorizing the Department of Planning and Economic Development to execute a joint powers agreement, containing an indemnification clause, with Ramsey County and other metro jurisdictions regarding efforts to implement fair housing initiatives in the Seven-County Metropolitan Area.
Body
WHEREAS, Anoka County HRA, Dakota County, Hennepin County, Ramsey County, Washington County, the City of Coon Rapids, the City of Minneapolis, the City of Woodbury, and the City of Saint Paul (collectively the "Jurisdictions"), all recipients of federal funding from the U.S. Department of Housing and Urban Development ("HUD") and the Metropolitan Council formed the Fair Housing Implementation Council ("FHIC") to analyze impediments to fair housing choice and initiate fair housing activities that affirmatively further fair housing choice for all residents within the jurisdictions during the HUD program year; and
WHEREAS, the FHIC annually approves fair housing initiatives in recognition of the 2009 Regional Analysis of Implementation to Fair Housing Choice; and
WHEREAS, each Jurisdiction, including the City of Saint Paul, will annually contribute funds to implement fair housing actions; and
WHEREAS, Ramsey County has agreed to serve as the contract manager and fiscal agent for the fair housing initiatives to be contracted with funds provided through this Joint Powers Agreement; and
 
WHEREAS, the Saint Paul City Council finds that the efforts of the FHIC have a legitimate public purpose in furthering the goals of eliminating impediments to fair housing choice; and
WHEREAS, the expenditures of public funds, which includes the promise of indemnification, for such a purpose will allow fair housing initiatives to take place.
NOW BE IT RESOLVED, that the Council of the City of Saint Paul hereby authorizes the appropriate city officials to execute the attached Cooperative Funding Agreement, which contains an indemnification clause, with the Jurisdictions.  
 
BE IT FINALLY RESOLVED, that nothing herein shall waive any statutory defenses or immunities to which the City of Saint Paul is entitled, nor shall this be construed as a waiver of the municipality's tort liability set forth in Minnesota Statute ยง466.01d et seq.
