Granting a temporary construction easement to the Minnesota Department of Transportation over a portion of city-owned Cayuga Park.

WHEREAS, the City of Saint Paul ("City") owns park land, Cayuga Park, located at 198 Cayuga Street ("Park Property") that is adjacent to Hwy. 35 E across L'Orient Street on its easternmost boundary. The Park Property is maintained by the Department of Parks and Recreation ("Department"); and
WHEREAS, the Minnesota Department of Transportation ("MnDOT") is planning Hwy. 35 E reconstruction projects that include relocation of the Pennsylvania Avenue/Phalen Boulevard interchange to Cayuga Street for improved interchange spacing; and
WHEREAS, MnDOT requires a 10-foot by 219-foot temporary construction easement along the north side of the Park Property for reconstruction of that part of Cayuga Street associated with the reconstruction of Hwy. 35 E, and the new interchange; and
WHEREAS, MnDOT is offering to purchase said easement for Five Thousand 00/100 Dollars ($5,000); and
WHEREAS, the Real Estate Manager has determined this to be a fair and reasonable value as determined by an appraisal and agreed to between the City and MnDOT; now, therefore be it
           
RESOLVED, by the Council of the City of Saint Paul, that the proper City officials are hereby authorized and directed to grant a temporary easement to MnDOT, in a form and content substantially as set forth in Exhibit A attached hereto, and to accept payment for said easement, to be deposited in the proper Department account.
