Approving the issuance of a Liquor Outdoor Service Area (Patio) license for Town House Country Inc, d/b/a Town House, 1415 University Avenue.

 

Body

WHEREAS, Town House Country Inc d/b/a Town house at 1415 University Avenue in Saint Paul, has requested the issuance of a Liquor Outdoor Service Area (Patio) license; and

WHEREAS, the Council finds that issuance of the license with conditions will not interfere with the reasonable use and enjoyment of neighboring property and residences and will not bear adversely on the health, safety, morals and general welfare of the community; and

WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the license; and

WHEREAS, notice was provided to neighboring properties as required under Legislative Code section 310.04(d)(1) regarding Licensee's proposed patio.  One letter of concern was received but was addressed by the agreed upon conditions specified below; therefore, be it,

 

RESOLVED, that a Liquor Outdoor Service Area (Patio) license is hereby issued to Town House Country Inc d/b/a Town house at 1415 University Avenue in Saint Paul, subject to the agreement stated above and the following preexisting license conditions:

 

1.  Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), Licensee will obtain a new Obstruction Permit from the Department of Public Works.  Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of Licensee's licenses.

 

2.  No outdoor food and/or beverage preparation is allowed on a public sidewalk without prior approval and additional licensing from DSI.

 

3.  Licensee will maintain general liability and liquor liability insurance which specifically includes coverage for the outdoor patio seating area, and names both the City of Saint Paul and the Housing and Redevelopment Authority of the City of Saint Paul as an additional insured under the policy.

 

4.  The patio will close at 10 PM daily.

 

5.  Licensee will provide sufficient security to insure an orderly exit of patrons at bar close. Security will be clearly identifiable.

 

6.  Licensee will ensure that the 48" clear walkway is maintained at all times.

 

7.  When the patio is open, there will be no tables and chairs in the approved sidewalk service area west of the light pole.

 

8.  Any failure to comply with these conditions or other license requirements may result in the initiation of adverse action according to the procedures in Legislative Code section 310.05.
