WHEREAS, in the matter of the Appeal of J. D. Nelson Construction, on behalf of Steve Hanson, to an Egress Window Non-Compliance Determination at 2101 BURNS AVENUE.; the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant;
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal on the two replacement egress bedroom windows unless the contractor can provide photographs showing the windows can open to 16 inches high; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
