Authorizing the Department of Parks and Recreation to enter into an agreement with the University of Minnesota, which includes an indemnification clause, to accept the donation of three trees valued at $750 to be planted in the city's arboretum located at Horton Park, and to thank the University for its generous gift.

WHEREAS, The University of Minnesota Department of Horticulture provides education and research on trees as part of its mission; and
WHEREAS, the University has offered to donate three trees, valued at $750, to the Department of Parks and Recreation for the purpose of planting in the city's arboretum located at Horton Park, 1383 Minnehaha Avenue W.; and
WHEREAS, the agreement requires that the grantee indemnify the University from any loss, claim, damage, or liability that may arise from or in connection with such agreement or the use of the trees or confidential research information; and
WHEREAS, the Saint Paul City Council finds that accepting the donation will further public education through the University's research and will enhance the public's enjoyment of the city's arboretum; now, therefore, be it
RESOLVED, that the appropriate city officials are hereby authorized to enter into an agreement with the University of Minnesota, which includes an indemnification clause, to accept the donation of three trees and the City Council thanks the University for its generous gift.
