Authorizing the release of additional (Round 2) Utility Easements within the Saint Paul Port Authority's Beacon Bluff Development.

 

Body

WHEREAS, a request has been received by the Saint Paul Port Authority for the release of utility easements within the parcels legally described in Exhibit A attached hereto; and

 

WHEREAS, the public and private utilities with easements in said parcels have determined that their easement rights, as identified below, may be waived, released and terminated; now, therefore be it

 

RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of the City of Saint Paul - Public Works, a municipal corporation; the Saint Paul Regional Water Services, a municipal corporation; Comcast, a Pennsylvania corporation; Northern States Power Company d/b/a Xcel Energy, a public utility; CenturyLink, a Louisiana corporation; and Verizon, a Delaware corporation (MCI Network Services, Inc); and made a part hereof by this reference and filed in the Office of the Financial Services Real Estate Section; the City, for itself and on behalf of said public utilities and corporations, hereby waives, releases and terminates the following utility easement rights:

 

   1.  The utility easements reserved in favor of the Department of Public Works, the Board of Water Commissioners, Northern States Power Company d/b/a Xcel Energy, Qwest Corporation (CenturyLink), Comcast of Saint Paul, Inc., and MCI Network Services, Inc. (Verizon), and easements reserved pursuant to Chapter 130 of the Saint Paul Legislative Code, contained in that certain City Council Resolution filed of record as Document Nos. 4031589 and 2006068, which relate to the vacation of a right-of-way and portions of Reaney Avenue and an alley in Block 3, Hill's Addition (Parcel 2); and

   2.  The utility easements reserved in favor of the Department of Public Works, the Board of Water Commissioners, Northern States Power Company d/b/a Xcel Energy, US West Communications (CenturyLink), and Continental Cablevision (Comcast), and easements reserved pursuant to Chapter 130 of the Saint Paul Legislative Code, contained in that certain City Council Resolution filed of record as Document Nos. 3054791 and 1186180, which relate to the vacation of a right-of-way triangle in the southeast corner of Lot 30, Block 2, Hills Addition to St. Paul (Parcel 2); and

   3.  The utility easements reserved in that certain City Council Resolution filed of record as Book L Misc., Page 232 (1883), which relates to the vacation of an Alley located in Block 1 of Hills Addition to Saint Paul (Parcel 2);

   4.  The utility easesments reserved pursuant to Ordinance 3394 contained in that certain City Council Resolution filed of record as Document Nos. 1186408, 260344, 1186409 and 260345, which relate to the vacation of portions of Fauquier Avenue (Parcel 2);

   5.  The utility easement reservations contained in that certain City Council Resolution filed of record as Document Nos. 2047456 and 2047457, which relate to the vacation of portions of Fauquier Avenue (Parcel 2); and

   6.  The utility easements reserved pursuant to Ordinance 3394 contained in that certain City Council Resolution filed of record as Document Nos. 1190200 and 1190201, which relate to the vacation of an Alley in Block 2 of Hills Addition to Saint Paul (Parcel 2); and

   7.  The utility easement reservations contained in that ceratin City Council Resolution filed of record as Document Nos. 2047452 and 2047453, which relate to the vacation of an Alley located in Block 2, Hills Addition (Parcel 2); and

   8.  The utility easements reserved in favor of the Department of Public Works, the Board of Water Commissioners, Northern States Power Company d/b/a Xcel Energy, Qwest Corporation (CenturyLink), Comcast of Saint Paul, Inc. and MCI Network Services, Inc. (Verizon) contained in that certain City Council Resolution April 20, 2005, bearing C.F. No. 05-345 (Parcel 2); and be it further

RESOLVED, that notwithstanding the foregoing, the easement rights presently established within vacated Mendota Street from the southerly right-of-way line of the BNSF Railway to the northwesterly line of Seventh Street East shall remain in full force and effect; and be it finally

RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee said easement rights are released and the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution.
