Purpose of Appeal
There are two units in condo association that are bank owned and one unit in the forclosure process.  Association has not been able to contact bank regarding bills and/or repairs necessary.  The owner with the unit in foreclosure has no intensions of investing in repairs.  Does not intend to redeem the property.  Additionally, there are items listed that do not...effect fire safety.

Body
WHEREAS, in the matter of the Appeal of Regina Bachmeier to a Fire Certificate of Occupancy Inspection Correction Notice at 1764 PORTLAND AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends 1) denying the appeal and granting an extension to March 1, 2012 for Unit 4 repairs; 2) granting the appeal allowing the bed in the rear room of Unit 3 can remain but cannot be used for sleeping purposes; and 3) grant an extension on the repairs for unoccupied untis, provided they are not occupied until the Fire Certificate of Occupancy is granted for those areas within the building; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
