Approving adverse action against all licenses held by Walgreen's #06995, 1788 Old Hudson Road.
 
Body
WHEREAS, adverse action was taken against all licenses held by Walgreen's #06995 d/b/a Walgreen's #06995 (License ID #20020005083) for the premises located at 1788 Old Hudson Road in Saint Paul by Notice of Violation dated February 16, 2012, alleging the licensee was cited for one (1) Critical-Major Environmental Health Code violation during a re-inspection of the licensed premises on January 23, 2012; and   
 
WHEREAS, pursuant to Saint Paul Legislative Code ยง 310.05 (m) (9), the licensing office recommended a $200.00 matrix penalty for the one (1) violation and suspension of all licenses until the violation was corrected; and
WHEREAS, the licensee did not respond to the Notice of Violation to pay the $200.00 matrix penalty and contact the inspector to schedule a re-inspection; and   
 
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $200.00 matrix penalty and contact the inspector to schedule a re-inspection by February 27, 2012, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that all licenses held by Walgreen's #06995 d/b/a Walgreen's #06995 are hereby immediately suspended and the licensee is ordered to pay a matrix penalty of $200.00 for failure to correct one (1) outstanding Critical-Major Environmental Health Code violation cited by the inspector during the re-inspection of the licensed premises on January 23, 2012.
 
The licenses shall remain suspended until the licensee corrects the one (1) outstanding Critical-Major Environmental Health Code violation and pays the $200.00 matrix penalty.
