Yes, for the windows with opening dimensions of 16 inches high by 29 inches wide - 8 inches in egress opening height, for the window measuring 19.5 inches high by 33 inches wide - 5 inch variance in egress opening height; for the sill heights of 55 inches, a 7 inch vairance if at least one standard size step running the length of the window is installed and permanently affixed to the wall.

WHEREAS, in the matter of the Appeal of Lisa Hertle, on behalf of Crocus Hill Real Estate, to a Fire Certificate of Occupancy Correction Notice at 423 FRY STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant an 8-inch variance on the openable height of the egress windows in the two bedrooms; grant a 4.5-inch variance on the openable height of the egress windows in the third bedroom; grant a variance provided appellant installs steps to address the sill height issue; grant an extension to March 1, 2012 on the balance of the items, except for the exterior repair and painting where there shall be an extension to June 1, 2012; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
