Amending Council File RLH FCO 11-526, adopted December 21, 2011, to grant Nadja Berneche additional extension for property at 460 MARSHALL AVENUE.

WHEREAS, on December 21, 2011, the City Council of the City of Saint Paul adopted Council File #RLH FCO 11-526, said Resolution being the memorialization of an appeal to a Fire Certificate of Occupancy Correction Notice for property at 460 Marshall Avenue; and
WHEREAS, the Legislative Hearing recommended that the City Council 1) grant a 2.5-inch variance on the openable width of the egress bedroom window in Unit 1 which measures 35 inches high by 17.5 inches wide; 2) Until items are dealt with, Unit 3 cannot be occupied after January 1. (Inspector to do a condemnation in Unit 3 effective January 1, 2012); and 3) Deny the appeal and grant an extension to January 3, 2012 to address the plumbing and sprinkler issues; however, if a work plan is submitted prior to that date, a hearing will be set up to review the work plan and amend the Legislative Hearing Officer's recommendation to the Council; and
WHEREAS, the Saint Paul City Council considered the Legislative Hearing Officer's recommendation in this matter; and
WHEREAS, the Appellant is requesting additional extension for the compliance with the correction order applying to repair the items in Unit #3 and the balance of the work; and
WHEREAS, the Legislative Hearing recommends granting additional extension; Now Therefore, Be It,
RESOLVED, that an extension is hereby granted to March 31, 2012.
