No hearing necessary.  It appears from the measurements that the only problem with the window dimensions is that the minimum sill height is 58", rather than 48".
 
Variance Recommendation
Yes, 10 inches in the minumum sill height of the egress window opening, if 2 steps of standard dimensions are installed and permanently affixed to the wall.
 
Body
WHEREAS, in the matter of the Appeal of Eric Lein to a Fire Certificate of Occupancy Correction Notice at 894 GRAND AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant variances on the sill height issue in Units B1, B2 and B3 provided two fixed steps are installed below the egress bedroom windows (5" - 7" in height and full width) and tread must be a minimum of 10" in depth; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
