Approving adverse action against all licenses held by RAS Ethiopian Bar & Restaurant, LLC, d/b/a RAS Restaurant & Lounge, 2516 - 7th Street West.

WHEREAS, adverse action was taken against all licenses held by RAS Ethiopian Bar & Restaurant, LLC d/b/a RAS Restaurant & Lounge (License ID #20100000062) for the premises located at 2516-7th Street West in Saint Paul by Notice of Violation dated November 18, 2011, alleging that on October 23, 2011, Saint Paul Police requested a videotape concerning an assault that took place at the licensed establishment and the licensee was unable to provide the videotape "immediately upon request" in violation of license condition #3; and
 
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (2), the licensing office recommended a $500.00 matrix penalty; and    
 
WHEREAS, licensee did respond to the Notice of Violation to request a public hearing which was held on December 21, 2011; now, therefore, be it
RESOLVED, that RAS Ethiopian Bar & Restaurant, LLC d/b/a RAS Restaurant & Lounge is hereby ordered to pay a matrix penalty of $500.00 for failure to provide a videotape "immediately upon request" to the Saint Paul Police Department.  Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.     
 
This resolution, and action taken above, is based upon facts contained in the November 18, 2011 Notice of Violation sent to the licensee and the arguments made at the public hearing on December 21, 2011.
