Approving adverse action against the Cigarette/Tobacco license held by Fa Khir, Inc., d/b/a Fa Khir, 2430 University Avenue West.

WHEREAS, adverse action was taken against the Cigarette/Tobacco license held by Fa Khir, Inc. d/b/a Fa Khir (License ID #20090001645) for the premises located at 2430 University Avenue West in Saint Paul by Notice of Violation dated November 3, 2011, alleging that on October 16, 2011, the licensee had eighty (80) individuals inside the establishment when the occupancy limit set by Fire Inspection was forty-three (43); and
WHEREAS, per Saint Paul Legislative Code ยง 310.05 (m) (2), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, licensee did not respond to the Notice of Violation to pay the $500.00 matrix penalty or request a hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a hearing in writing by November 14, 2011, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that Fa Khir, Inc. d/ba/ Fa Khir is hereby ordered to pay a matrix penalty of $500.00 for exceeding the occupancy limit of forty-three (43) individuals within the licensed establishment on October 16, 2011. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
