Purpose of Appeal
The neighboring property was excavated to put in a parking lot requiring the need for a retaining wall. This wall fell and it states in federal law that I have the right to Lateral Support. (Please see attached) Attachment 2.

WHEREAS, in the matter of the Appeal of Donald Moschkau to a Correction Order at 410 MAPLE STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal and grant an extension for one month to July 15, 2012 to clean up the remaining debris and until June 30, 2012 September 1, 2012 to repair the retaining wall under permit; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
