Authorizing the City to enter into a cooperative agreement with Ramsey County for sidewalk construction on Larpenteur Avenue from Dale Street to Marion Street and Edgerton Street from Arlington Avenue to Maryland Avenue.
Body
WHEREAS, the City plans to construct sidewalks on Larpenteur Avenue (County State Aid Highway 30) from Dale Street to Marion Street, and Edgerton Street (County State Aid Highway 58) from Arlington Avenue to Maryland Avenue (the “Project”); and
WHEREAS, pursuant to the provisions of Minnesota Statute Section 471.59, two or more governmental units, by agreement entered into through action of their governing bodies, are authorized to enter into agreements to exercise jointly or cooperatively governmental powers common to each and to permit one governmental entity to perform services or functions for another governmental unit; and
WHEREAS, the City and the County (the “Jurisdictions”) are governmental units as defined in Minnesota Statutes Section 471.59; and
WHEREAS, the Project is a collaboration between the City and Ramsey County; and
WHEREAS, the agreement allows the Jurisdictions to undergo joint procurement and contract award efforts, share project costs, and outlines the responsibilities of the Jurisdictions related to the ownership and maintenance responsibilities for the roadways, sewers, and sidewalks on the Project; and
WHEREAS, the agreement contains a mutual indemnification clause between the County and City, which the Council finds appropriate in order to effectuate the Project; and, now, therefore be it
RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for and on behalf of the City to enter into Ramsey County Agreement PUBW2023-06, a copy of which is before Council and is made a part hereof; and, be it further
RESOLVED, that the Mayor and the proper City Officials are authorized to execute this agreement and any amendments to this agreement.
