Approving the release of a water utility easement, in the name of the City, located on property at 893 Tanglewood Drive, Shoreview, MN.

WHEREAS, an easement for water utility purposes was acquired, by the City of St. Paul, MN (City), on property located at 893 Tanglewood Drive, Shoreview, MN.(Property); and
WHEREAS, said easement was recorded in Ramsey County, MN. property records as a Document in Book 103, page 427 on August 5, 1882 (Easement); and
WHEREAS, Bill DeWitt of Zawadski Homes, on behalf of Property owners Tom and Sheila Bonfe, has requested the release of the Easement on said Property, in order to facilitate new improvements; now, therefore, be it
RESOLVED, that with the Certificate of Intended Non-Use, filed voluntarily on behalf of the City, by the St. Paul Regional Water Services, Board of Water Commissioners (fka St.Paul Water Company), the City, for itself and on behalf of said utility, hereby waives, releases and terminates said Easement encumbering the Property, as depicted in Exhibit A ; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper City officials are hereby authorized and directed to record a copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution; and be it finally
RESOLVED, that any remaining Easement rights shall remain in full force and effect and be fully incorporated into this resolution.
