Approving adverse action against the Cigarette/Tobacco license held by Walgreens Co., d/b/a Walgreens #16476 at 398 Wabasha Street North.

WHEREAS, the Cigarette/Tobacco license held by Walgreens Co. d/b/a Walgreens #16476 (License ID #20170004001) for the premises located at 398 Wabasha Street North in Saint Paul, was the subject of a Notice of Violation dated August 24, 2018, stating an employee of the licensee sold Newport cigarettes to an underage person on July 17, 2018, in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (c) and (d); and
WHEREAS, per Saint Paul Legislative Code § 324.11(b) (1), the licensing office recommended a $200.00 matrix penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $200.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $200.00 matrix penalty or request a public or administrative hearing by September 4, 2018, that the matter would be placed on the September 19, 2018 consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Walgreens Co. d/b/a Walgreens #16476 (License ID #20170004001) for the premises located at 398 Wabasha Street is hereby ordered to pay a $200.00 matrix penalty for the sale of tobacco products to an underage person on July 17, 2018
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
