Title
Authorizing the Police Department to enter into an agreement with Apple for use of their Volume Purchase Programs.
Body
WHEREAS, the Police Department is in the process of implementing a solution for smart phones used by department employees in the conduct of city business; and
WHEREAS, the police department has determined that administration of the solution for police purposes requires a separate Apple Volume Purchase Program; and
WHEREAS, the Apple Volume Purchase Program requires acceptance of standard terms and conditions, which the company will not alter and which include an indemnification clause; and
WHEREAS, the City Council finds that the promise of indemnification is appropriate to obtain the optimal communication solution for mobile employees; and
WHEREAS, the Volume Purchase Program also requires that any litigation be subject to California law and venue, and the City Attorney’s Office has advised that it will accept the restriction if the police department accepts responsibility for any additional costs associated with the choice of venue; now, therefore, be it
RESOLVED, that the police department is authorized to accept the Terms of Use for the Apple Volume Purchase Program.
