Approving the application of Michels Corporation for a sound level variance for a 30-hour construction project for sewer lining work, on Jackson Street from the intersection of Fifth Street South to Kellogg Boulevard, continuously from Monday, April 11, 2016 through Tuesday, April 12, 2016.

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and
WHEREAS, §293.09 provides for the granting of variances from the sound level limitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and
WHEREAS, Michels Corporation, represented by Willie Grams, Project Manager, who has been designated as the responsible person on the application, has applied for a variance for construction work related to the installation of the sewer liner on Jackson Street from the intersection of 5th Street to Kellogg Boulevard for the 30 hour continuous project, and to allow elevated sound levels 24-hours per day along Jackson Street for activities such as asphalt removal, concrete curb and gutter cutting and replacement, manhole coning, setting up a cured in place pipe inversion tower, stage boiler trucks with silenced pump running, hand power tools, back up beeping and operation of boiler truck; and
WHEREAS, in order to meet required Public Works project completion and to minimize disruption to traffic on Jackson Street, area businesses, the public, adjoining residents and property owners, the applicant is seeking a variance from Monday, April 11, 2016 to Tuesday, April 12, 2016; and the applicant is requesting night work sound levels from 10:00 p.m. on April 11, 2016 until 7:00 a.m. on April 12, 2016 to be at 70 dBA at 50 feet from the sound source; and
WHEREAS, if applicant is not granted a variance, Michels Corporation will not be able to operate general...
