Accepting a public sidewalk and public utility easement from the Friends of Highland Ball in conjunction with planned future street construction at the former Ford plant redevelopment site.
Body
WHEREAS, the former Ford plant site in Saint Paul continues to undergo redevelopment activities, including the recent platting of city blocks, parkland and streets; and
WHEREAS, the planned westerly extension of Montreal Avenue beginning at Cleveland Avenue will extend across property owned by Project Paul, LLC, legally described as Lot 1, Block 30, FORD, according to the recorded plat thereof, Ramsey County, Minnesota; that is used as little league ballfields ("Ballfield Property"); and
WHEREAS, Project Paul, LLC intends to convey the Ballfield Property to the Friends of Highland Ball ("Future Owner") that operates the Ballfield Property; and
WHEREAS, as part of the future street development plan, the Department of Public Works ("Public Works") of the City of Saint Paul ("City") is requiring a permanent public sidewalk and public utility easement ("Easement") over the portion of the Ballfield Property located at the planned northwest corner of the intersection of Montreal Avenue and Cleveland Avenue; and
WHEREAS, the Future Owner has agreed to provide the Easement and is now requesting that the City accept the Easement, as provided in Exhibit A to Resolution attached hereto; and
WHEREAS, Public Works has reviewed and approved the Easement as attached; now, therefore be it
RESOLVED, that, subject to the conveyance of the Ballfield Property to the Future Owner, the Council of the City of Saint Paul does hereby accept the Easement in a form and content substantially as set forth in Exhibit A to Resolution attached hereto, and authorize the proper city officials to accept an executed original and record same with the Ramsey County Recorder's office and/or Registrar of Titles.
