Amending Appendix B of the Legislative Code relating to Northern States Power, D/B/A Xcel Energy, Gas Franchise.

The City Council of the City of Saint Paul ordains as follows:
Section 1. That the Legislative Code, Appendix B be repealed and replaced in its entirety as follows:
APPENDIX B - GAS FRANCHISE - NORTHERN STATES POWER, D/B/A XCEL ENERGY
An ordinance granting to Northern States Power Company, a Minnesota Corporation, d/b/a Xcel Energy, its successors and assigns, a nonexclusive franchise to construct, operate, repair and maintain gas facilities in the public rights-of-way for the transportation, distribution, manufacture, and sale of gas services to the city, its inhabitants, and others in the city of Saint Paul Minnesota, and prescribing certain terms and conditions thereof.
Section 1. Definitions. For purposes of this Ordinance, the following capitalized terms listed in alphabetical order shall have the following meanings:
1.1. City Utility System. Facilities used for providing public utility service owned or operated by the City or agency thereof, including, but not limited to, sewer, water, and storm water service.
1.2. Commission. The Minnesota Public Utilities Commission, or any successor agency or agencies, including an agency of the federal government, which preempts all, or part of the authority to regulate gas retail rates now vested in the Minnesota Public Utilities Commission.
1.3. Company. Northern States Power Company, a Minnesota corporation, its successors, and assigns, including all successors or assigns that own or operate any part or parts of the Gas Facilities subject to this Franchise.
1.4. Franchise. The non-exclusive grant of the privilege to use the public rights-of-way made by the City to the Company in this Ordinance, subject to the terms and conditions of this Ordinance.
