Appointing Briggs and Morgan, P.A as special counsel, and authorizing an agreement for outside counsel services between the City Attorney’s Office and Briggs and Morgan, P.A.

 

Body

WHEREAS, Saint Paul City Charter § 5.02 permits the City, upon request of the City Attorney in the case of special or unusual circumstances or to prevent an impermissible conflict of interest on the part of the City Attorney, to appoint outside counsel to represent the City; and 

 

WHEREAS, the City is in need of an attorney with expertise in the area of labor and employment law for the purpose of providing advice and counsel on personnel matters and to prevent an impermissible conflict of interest on the part of the City Attorney; and

 

WHEREAS, the City Attorney requests and recommends the appointment of outside counsel because of the above-articulated need; and

 

WHEREAS, the City Attorney requests and recommends that the City hire the firm of Briggs and Morgan, P.A., under the direction of attorney Ellen Brinkman; now, therefore be it

 

RESOLVED, that upon request and recommendation of the City Attorney, the Council of the City of Saint Paul does hereby appoint Briggs and Morgan, P.A. as special counsel and authorizes the appropriate City officials to enter into an agreement with Briggs and Morgan, P.A., under the direction of attorney Ellen Brinkman, for the purpose of providing advice and counsel on personnel matters and preventing an impermissible conflict of interest on the part of the City Attorney. The compensation to be paid for the services of said special counsel shall not exceed $225 per hour, shall be reasonable, and shall take into account the factors listed in Rule 1.5 of the Rules of Professional Conduct.
