Approving a Gambling Location license with conditions to be added to existing licenses for Pat McGovern’s Inc d/b/a Pat McGovern’s Pub (License ID #0016366) at 225 Seventh Street West.

WHEREAS, for Pat McGovern’s Inc d/b/a Pat McGovern’s Pub (License ID #0016366) applied for a Gambling Location license for the premises located at 225 7th Street West in Saint Paul; and
WHEREAS, The Licensee currently holds a Liquor On Sale - 291 seats or more, Liquor On Sale - Sunday, Liquor- Outdoor Service Area (Patio), Liquor On Sale - 2 AM Closing and Entertainment (A) licenses and
WHEREAS, the Department of Safety and Inspections received no objections to approval of the above-mentioned license; and
WHEREAS, the Council finds that the license conditions are reasonable given the license applied for, the application is in order and there are no grounds to deny approval of the Gambling Location license now, therefore, be it,
RESOLVED, a Gambling Location license is hereby approved for Pat McGovern’s Inc d/b/a Pat McGovern’s Pub (License ID #0016366) for the premises located at 225 7th Street West in Saint Paul with the following conditions:
1. In lieu of the need for a shared parking agreement, on April 6, 2009, the Board of Zoning Appeals approved a parking variance for 55 off-street parking spaces, including a condition that the applicant provides and maintains bike racks or lockers on site for patrons in compliance with an approved site plan on file with the Department of Safety and Inspections (DSI).
2. Smoking is not permitted in the expanded space at 241 7th St W.
3. The space at 241 7th St W is licensed as a seasonal space and can only be used when the entire outdoor service seating area (patio) is open and serving patrons.
4. Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is, "Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the...
